IV. Equal land rights for women



In 2009, less than one-third (29%) of the total Emancipation Patents/Certificates of Land Ownership Award (EPs/CLOAs) distributed during that year were awarded to women beneficiaries.

In 2011, the Department of Agriculture (DAR) issued an Administrative Order (AO) 01-11 providing the guidelines for gender equality in the implementation of agrarian reform laws and mainstreaming Gender and Development (GAD) in the DAR. The salient provisions of the policy include having equal rights as with the spouse in the process of identification, screening, and selection of agrarian reform beneficiaries (ARBs); decisions of a spouse shall be binding upon the other in the event the other spouse is absent; both spouses’ names shall appear in the EP or CLOA; joint leasehold or separate leasehold contracts may be executed; the award limit for legally-married spouses and for common-law partners is 3 ha; and the consents of both spouses are required for the validity of land transactions.
